Terms of Service

These Terms of Service (“Terms”) govern your use of the Faxloo fax-by-internet service (“Service”) provided by Faxloo (“we,” “us,” or “our”). By using the Service, you agree to these Terms.

1. Service Description

Faxloo is a transactional fax transmission service. Users upload or compose documents in our web or mobile applications, we render them to a fax-compatible format, and we transmit them via the public switched telephone network (PSTN) to recipient fax numbers.

2. Account Registration

To use the Service, you must:

• Be at least 13 years old (16 in the EU)
• Provide accurate registration information
• Maintain the security of your password
• Be responsible for all activity under your account

3. Acceptable Use

You agree NOT to use the Service to:

• Send unsolicited bulk fax (spam) or content that violates the Telephone Consumer Protection Act (TCPA) or similar regulations
• Transmit illegal content, including but not limited to child sexual abuse material, malware, or fraudulent communications
• Impersonate another person or entity
• Violate any applicable law or regulation
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Use automated tools to abuse the Service or evade rate limits

We reserve the right to suspend or terminate accounts that violate this section.

4. Subscription Plans and Billing

Plans

The Service is offered in:

• Free plan: limited monthly fax credits, no payment required
• Subscription plans (Basic, Pro, Business): monthly or annual recurring billing with included fax credits
• Pay-as-you-go credits: one-time purchases of additional fax credits

Current pricing is displayed on https://faxloo.com and may change with 30 days’ notice for active subscribers.

Payment

• Subscriptions are billed in advance via Stripe
• One-time credit packs are charged at the time of purchase
• All amounts are in USD unless otherwise stated
• Failed payments may result in service suspension after retry attempts

Refunds

Subscription fees are non-refundable. Unused fax credits are non-refundable upon account cancellation. We will issue refunds for billing errors or service disruptions at our discretion. Contact support@faxloo.com within 30 days of any disputed charge.

Cancellation

You may cancel your subscription at any time via your Account page. Cancellation takes effect at the end of the current billing period. After cancellation, you retain access to remaining credits until they expire (90 days post-cancellation).

5. Fax Delivery

We use the Sinch Fax API to transmit faxes to recipients via the PSTN. Delivery is subject to:

• The recipient’s fax line being operational
• Valid recipient phone numbers (E.164 format)
• Successful PSTN routing

We retry failed transmissions per Sinch’s default retry policy. Faxes that fail after retries are marked as failed in your Outbox; credits are refunded for failed transmissions.

6. Intellectual Property

The Service, including its software, design, and branding, is owned by Faxloo. You retain ownership of the documents you transmit. By using the Service, you grant us a limited license to process and transmit your documents solely to deliver the Service.

7. Privacy

Your use of the Service is also governed by our Privacy Policy.

8. Termination

You may terminate your account at any time. We may terminate or suspend your account if you violate these Terms or for any reason with reasonable notice. Upon termination:

• You lose access to the Service immediately
• Your data is deleted within 30 days (per Privacy Policy retention rules)
• Outstanding payments remain due

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant uninterrupted service, error-free operation, or fitness for a particular purpose.

10. Limitation of Liability

To the maximum extent permitted by law, Faxloo’s total liability arising from or related to these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

11. Indemnification

You agree to indemnify and hold Faxloo harmless from claims arising from your use of the Service in violation of these Terms or applicable law.

12. Governing Law

These Terms are governed by the laws of the State of [STATE / JURISDICTION TO BE FILLED IN], without regard to conflict-of-law principles. Any disputes will be resolved in the courts located in [STATE / JURISDICTION].

13. Changes

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Continued use of the Service after changes constitutes acceptance.
